This Participant Agreement & Waiver (“Agreement”) is entered into by and between the undersigned participant (“Participant”) and KO Yoga Retreats (“Retreat Organizer”).
1. Retreat Description
Participant understands that KO Yoga Retreats may include yoga classes, meditation, movement practices, workshops, outdoor experiences, cultural or community activities, and group gatherings. Activities may take place indoors and outdoors and may involve varying terrain, weather conditions, and levels of physical exertion.
2. Assumption of Risk
Participant acknowledges that participation in yoga, movement, meditation, and related retreat activities involves inherent risks, including physical injury, emotional release, illness, or loss. Participant voluntarily assumes all risks associated with participation and agrees to listen to their body, exercise personal judgment, and modify or opt out of activities as needed.
Participant confirms they are physically and mentally able to participate and have consulted a medical professional if necessary.
3. Release of Liability
Participant, on behalf of themselves, their heirs, assigns, and personal representatives, fully releases and discharges KO Yoga Retreats, KO Yoga Company, and all instructors, facilitators, staff, volunteers, owners, agents, and affiliates from any and all claims, demands, actions, or causes of action arising from injury, illness, loss, or damage occurring during or after the retreat, including travel to and from the retreat, accommodation, and all retreat activities, to the fullest extent permitted by law.
4. Medical & Emergency Authorization
Participant authorizes KO Yoga Retreats staff to obtain emergency medical treatment on their behalf if Participant is unable to provide consent. Participant accepts full financial responsibility for any medical treatment received.
Participant agrees to disclose any relevant medical conditions, allergies, injuries, pregnancy, or physical limitations prior to the retreat.
5. Travel, Costs & Insurance
Participant acknowledges that the retreat fee does not include flights, gratuities for venue staff or shuttle drivers, travel insurance, or optional spa or massage add-on services. These expenses are the sole responsibility of the Participant.
Participant further understands that medical travel insurance is highly recommended to protect against unforeseen circumstances, including illness, injury, medical emergencies, or travel disruption.
KO Yoga Retreats is not responsible for travel delays, cancellations, missed connections, or additional costs incurred by the Participant.
6. Personal Property
Participant is responsible for their personal belongings, luggage, equipment, and valuables. KO Yoga Retreats and host venues are not responsible for lost, stolen, or damaged items.
7. Accommodation Acknowledgement
Participant understands that accommodations may be single occupancy or shared, depending on the option selected at booking. Participant agrees to respect shared spaces and fellow guests.
Participant acknowledges that certain accommodations may include open-air or semi-open bathing areas, and privacy considerations should be taken into account when sharing.
8. Media Release
Participant grants permission for KO Yoga Retreats to capture photographs, video, or audio recordings during retreat activities and to use such materials for promotional, educational, fundraising, or informational purposes without compensation.
If Participant does not consent, they must notify KO Yoga Retreats in writing prior to the retreat.
9. Respectful Conduct
Participant agrees to behave in a respectful, inclusive, and non-disruptive manner that supports a safe and welcoming retreat environment. KO Yoga Retreats reserves the right to remove any Participant whose behaviour is unsafe, disruptive, or harmful, without refund.
10. Cancellation & Refund Policy
Participant acknowledges that they have read, understand, and agree to the KO Yoga Retreats Cancellation Policy, including the non-refundable nature of the deposit and refund timelines outlined therein.
11. Governing Law
This Agreement shall be governed by and interpreted in accordance with the laws of the province or territory in which the retreat is held, and applicable federal laws of Canada.
